Outcomes For Children Who Were Deprived of Oxygen At Birth

There are many lawsuits against the maker of the Mirena IUD. Most are based upon claims that the device migrated out of the uterus and into the abdominal cavity causing infection, surgery, bleeding and even sterility. However, to my knowledge, no one has brought a case against Mirena for wrongful birth of a child when the device failed to prevent pregancy. If a user of the Mirena IUD believes that the device is in place and it has migrated, other forms of birh control must be used or an unintended pregnancy could result.

It’s not surprising that almost half of the reported problems with Mirena were expulsion—it’s relatively common, occurring in up to 5% of women who get an IUD. Expulsion is a fancy way of saying that an IUD has been pushed out of its ideal location at the top of the uterus. The uterus is one big muscle, so this sometimes happens. Billions Paid Out For Surgical Errors

Surgical “never events”, such as leaving a sponge in a patient, cost healthcare professionals and their insurance companies 1.3 Billion in malpractice payouts from 1990 to 2010. As published in Surgery magazine, researchers gathered data on 9,744 “never events” through the National Practitioner Data Bank, a federal reserve of medical malpractice claims. “Never events” were defined as retained foreign bodies, surgery on the wrong site, surgery on the wrong patient or performing the wrong surgical procedure on the right patient. Permanent injury occurred in 33% of the cases and 6.6% of the cases resulted in death.

The authors found that physicians with clinical privilege or state licensure disciplinary action reports were more likely to be named in multiple “never event” reports then were those who had no disciplinary history.

Anti-Epileptic Drugs Linked To Birth Defects

A new study conducted by researchers in Australia suggests that Topamax side effects could include a risk of Topamax birth defects. The study, which included both valproate and topiramate side effects, examined the link between the use of antiepileptic drugs while pregnant and the incidence of birth defects.

For the study, published in the journal Acta Neurologica Scandinavica (3/6/13), researchers at the Royal Melbourne Hospital and University of Melbourne examined the data of 1,733 fetuses from 1,703 pregnancies. Of those fetuses, 147 were not exposed to any antiepileptic drug during pregnancy. The goal of the study was to determine whether there was a link between fetal malformations and use of antiepileptic drugs during pregnancy. Included in the study were valproate (Depakote), carbamazepine (Tegretol) and topiramate (Topamax).
