On November 30, 2012, the Texas Supreme Court upheld a trial court verdict in favor of Aaron Felton. It was a rare win for a Plaintiff in a medical malpractice case in the Texas Supreme Court. Charles Dunn represented the winning Plaintiff who was suffered a stroke when he received a neck adjustment from chiropractor Brock Lovett, D.C.

The case was tried in December 2009 and made it all the way to the Texas Supreme Court. The Court, in a unamious decison, held that Chiropractors have a duty to warn patients that there is a risk that a patient will sustain a stroke when a chiropractor performs a neck adjustment…

Patients’ legal rights are constantly under attack in the state as well as federal level. For example, in Michigan when a resident is hurt by an unsafe drug or a medical device that was approved by the FDA, state law prohibits filing a lawsuit against the manufacturer. Amusement park rides injure over 4,000 children in the US every year, according to a recent report by researchers at the Center for Injury Research and Policy at the Research Institute at Nationwide Children’s Hospital in Columbus, Ohio.

The study, published in, show that between 1990 and 2010, nearly 93,000 children under the age of 18 were treated in the ER for amusement-ride-related injuries, which is an average of almost 4,500 injuries annually.

The researchers also found that 70 percent of the injuries happened during the warmer weather–May through to September–which equates to about 20 injuries per day during that time….
